These Terms and Conditions govern the use of the parking facilities and services offered by Harris Road Cruise & Airport Parking Pty Ltd (referred to as Sovereign Parking, we, us, or our). By entering the premises, making a booking (online, by phone, or in person), using our shuttle, or parking a vehicle with us, you (the customer, you, or your) accept and agree to be bound by these Terms in full.

1. DEFINITIONS

  • “Vehicle” refers to any motor vehicle brought into our car park by you or someone authorised by you.
  • “Booking” refers to any reservation made for parking, whether prepaid or paid on arrival.
  • “Car Park” refers to the physical premises at 9 Harris Road, Pinkenba QLD 4008.

2. CONDITIONS OF ENTRY

  • By entering our premises or using our services, you accept these Terms and acknowledge that:
    • a. You are parking entirely at your own risk.
    • b. We do not accept liability for theft, loss, damage, injury, or death arising from the use of our car park or shuttle.
    • c. This agreement does not create a relationship of bailment or custody. We do not take possession of your vehicle at any time.

3. LIABILITY AND RISK

  • To the maximum extent permitted by law, we are not liable for any:
    • a. Loss, theft, or damage to your vehicle or contents;
    • b. Damage caused by other drivers, weather, hail, animals, objects, or equipment;
    • c. Injury, illness, or death occurring on or near our premises or during shuttle transport, except where caused by our proven negligence;
    • d. Missed flights, cruises, or appointments due to delays, traffic, or operational issues;
    • e. Damage resulting from battery failure, flat tyres, or vehicle malfunctions.
  • In the rare case where we are found legally liable for proven negligence, our total liability is capped at $1,000 or the cost of repair, whichever is lower.

4. INDEMNITY

  • You agree to indemnify and hold us harmless for:
  • Any damage caused by you or your vehicle to our property or third parties;
  • Any claims made against us resulting from your conduct or breach of these Terms;
  • Any unauthorised or unlawful activity by you or others acting under your booking.

5. VEHICLE ACCESS AND RELEASE

  • We may release your vehicle to any person presenting what we deem to be satisfactory proof of ownership or authority.
  • You release us from liability for any consequences arising from this release.
  • Keys must be left with us when requested. You must ensure your vehicle is operable, legal, and safe to drive.
  • If we are unable to move or access your vehicle due to mechanical issues or unsafe condition, you may be charged additional costs for specialist assistance.

6. PAYMENTS AND CHARGES

  • All parking fees must be paid in full before collection of your vehicle.
  • You authorise us to charge your nominated credit/debit card for any outstanding fees or extra charges (e.g., overstays).
  • We have a lien over your vehicle and contents for unpaid fees and may retain possession until payment is received.
  • All prices are inclusive of GST unless otherwise stated.

7. BOOKINGS, CANCELLATIONS, AND OVERSTAYS

  • Bookings are only valid for the dates, times, and vehicle registration specified.
  • Bookings are non-transferable and non-refundable unless otherwise stated.
  • Early returns do not entitle you to any refund or credit.
  • If you stay beyond your booked time, you will be charged at the current standard daily rate for the extra time.
  • Cancellations or amendments may be made with 24 hours’ notice, subject to a $10 administration fee. No refund is available for cancellations within 24 hours of your booking time.

8. SHUTTLE SERVICE

  • One round-trip shuttle transfer is included per booking. Additional trips may incur a fee.
  • Shuttle availability is not guaranteed. We are not liable for missed flights or cruises.
  • Drivers may refuse carriage based on safety, capacity, or behaviour.
  • No standing, unaccompanied baggage, or unauthorised animals are permitted.

9. VEHICLE SUITABILITY

  • Vehicles must fit within a standard parking bay. Oversized vehicles may be refused entry or incur additional fees.
  • We reserve the right to refuse entry to any vehicle deemed unsafe or unfit for our facility.

10. ABANDONED VEHICLES

  • Vehicles left more than 14 days beyond their booking period without written notice may be deemed abandoned.
  • We reserve the right to report abandoned vehicles to authorities and recover any removal, storage, or disposal costs from you.

11. CCTV AND SURVEILLANCE

  • Our premises are under constant video surveillance for security and operational monitoring.
  • Footage is stored securely and may be shared with authorities when required by law.

12. PRIVACY POLICY

  • We collect your personal information (e.g., name, phone number, email, vehicle details, payment method) to:
  • Confirm bookings;
  • Communicate with you;
  • Operate our business efficiently;
  • Meet legal and regulatory obligations;
  • Provide limited marketing or feedback requests (opt-out available).
  • We store data securely and do not sell or rent your information. You may request access or corrections to your data at any time. Complaints can be made directly to us or through the Office of the Australian Information Commissioner (OAIC). A full Privacy Policy is available on request or at [Insert URL].

13. GENERAL LEGAL TERMS

  • These Terms are governed by the laws of Queensland, Australia.
  • We may update these Terms at any time. Continued use constitutes acceptance of the updated version.
  • If any clause is deemed unenforceable, the remainder of the agreement remains in effect.
  • These Terms apply whether you have a confirmed booking or simply enter and use our facility.
